Remember in 2008… When the whole world was convinced that then candidate Obama was a different kind of politician… a man of such brilliance and of such integrity that his very presence was going to change politic as we understood it???
And how he would return some meaning to the whole “Of, for, and by the People” part of the foundation of our Nation???
The same guy whose Campaign was floating out word just a few weeks ago that in his second term there would be a readdressing of the American Drug War (including much needed and called for fixes to the way the Federal Government looks upon Medicinal Marijuana and the States that allow it)???
Yea… turns out he was full of shit about all of it…
Furthering his trend of ignoring every single utterance he made to his constituency in order to get himself elected in 2008, Obama’s Administration has targeted the largest, most respected, and most successful medicinal marijuana dispensary in California for no other reason than it was there.
According to the LA TIMES:
“The federal government is moving to shut down the nation's largest and highest-profile medical marijuana dispensary operation, filing papers to seize properties in Oakland and San Jose where Harborside Health Center does business.
Copies of the federal Complaint for Forfeiture were taped to the front doors of the two dispensaries Tuesday, alleging that they were "operating in violation of federal law."
Medical marijuana advocates, as well as some state and local officials, decried the action, saying it hurts patients in legitimate need of the drug and breaks repeated promises by President Obama's Justice Department that it was targeting only operations near schools and parks or otherwise in violation of the state's law… “
And this wasn’t one of those dodgy “wink, wink I need medicine” pot stores that one would see a reason for kicking the doors in on…
Harborside Health Center has a permit in good standing to operate in the City of Oakland and with the State of California, was in complete compliance with all state laws and regulations (something Candidate Obama as well as President Obama has more than once said would be a key factor in the Administration’s decision to enforce Federal Laws), and a payer of MILLIONS in tax revenue to the State of California (something the cash strapped state could use more of… businesses that hire and pay their taxes…).
There had to be a good reason for the Administration to go back on all those promises it made to its supporters…
“…I now find the need to consider actions regarding marijuana superstores such as Harborside. The larger the operation, the greater the likelihood that there will be abuse of the state’s medical marijuana laws, and marijuana in the hands of individuals who do not have a demonstrated medical need…”
Makes sense… You allow for a business to exist, claim publicly that you will leave them alone so long as they follow State laws (which they had)… but the second that the business starts to actually engage in a little of that “success” stuff we keep hearing is so important in both business and economic growth and all of the sudden the doors get kicked in and property gets seized on the inkling that maybe there is some sort of impropriety???
Seems a little fucked up….
What we need is the words of President Obama on these matters… He can make everything better… remember, he does have that silky smooth voice…
Asked during an April interview with Rolling Stoneabout his Administration’s policy towards medicinal marijuana, President Obama made this statement:
Let me ask you about the War on Drugs. You vowed in 2008, when you were running for election, that you would not "use Justice Department resources to try and circumvent state laws about medical marijuana." Yet we just ran a story that shows your administration is launching more raids on medical pot than the Bush administration did. What's up with that?
Here's what's up: What I specifically said was that we were not going to prioritize prosecutions of persons who are using medical marijuana. I never made a commitment that somehow we were going to give carte blanche to large-scale producers and operators of marijuana – and the reason is, because it's against federal law. I can't nullify congressional law. I can't ask the Justice Department to say, "Ignore completely a federal law that's on the books." What I can say is, "Use your prosecutorial discretion and properly prioritize your resources to go after things that are really doing folks damage." As a consequence, there haven't been prosecutions of users of marijuana for medical purposes.
(Ironically, this fair minded President who has his hands so tied by “Congressional Law” in making the changes he feels are so needed in Drug Law seemed to have little issue in finding a way to make the very same sort of Congressional hand tying seemingly invisible while implementing elements of “The Dream Act” in order to shore up that dwindling Hispanic poll number , but I digress…)
In that same interview he went on to clarify his evolving stance on Medicinal Marijuana dispensaries…
The only tension that's come up – and this gets hyped up a lot – is a murky area where you have large-scale, commercial operations that may supply medical marijuana users, but in some cases may also be supplying recreational users. In that situation, we put the Justice Department in a very difficult place if we're telling them, "This is supposed to be against the law, but we want you to turn the other way." That's not something we're going to do.
In truth it sounds to me like this man is full of shit on MOST things (remember when Obamacare was not going to raise anyone’s taxes, would bring down costs for the Nation’s insured, and would be a blessing to any and all???? Or how detainment facilities like Gitmo and hyper-aggressive actions like drone assassinations needed to be stopped IMMEDIATELY lest the World lose total respect for the once great USA??? Yea… I rememeber too…Good times… good times…) and apparently is willing to say any and everything in order to get his lever pulled on Election Day.
